Stroke Disability Claims

A stroke occurs when blood flow that brings oxygen to an area of the brain stops. Without oxygen, the brain cells begin to die. There are different types of strokes:

Ischemic stroke occurs when a blood vessel carrying blood to the brain is blocked by a blood clot. Sometimes this is the result of a blood clot that is formed somewhere in the body, or it results from a blot that is created inside one of the arteries inside of the brain. About 87% of all strokes are ischemic. High blood pressure is the leading cause of ischemic strokes.

This is about a Social Security Disability claim.

Hemorrhagic stroke, where a weakened blood vessel in the brain bursts or leaks. This is the least common of strokes and usually results in death.

How severe a stroke is depends upon both where the stroke occurs and how much damage is done. Stroke is the leading cause of adult disability in America. People think of strokes happening to older adults, but nearly a third of all strokes happen to people under age 65.

Pursuing a Disability Claim for a Stroke

More than two thirds of people who experience a stroke never fully recover and must cope with some kind of disability. Most stroke victims would love nothing more than to return to their pre-stroke lives, including returning to work, but it is not always possible. When this happens, they need to file a claim for long-term disability insurance benefits.

Filing for long-term disability benefits after a stroke can be a challenge. One person may have a stroke and be able to return to work after undergoing rehabilitation, while another never recovers. A person with a job that requires complex decisions made fast, like a stock trader, may no longer have the cognitive functioning necessary to perform the tasks and duties of their job. A person who crisscrossed the country regularly to generate million of dollars in sales can’t get from one side of the airport terminal to another.

Frankel & Newfield long term disability insurance attorneys have represented many claimants who have suffered a stroke or an aneurysm and need help getting the benefits that they were promised. We understand the challenges facing claimants and how dealing with a large insurance company bureaucracy can be frustrating and overwhelming. Our clients benefit from our taking over their claim, handling all of the day-to-day details, working with their physicians and taking on the insurance company on their behalf. We fight the disability insurance company – you don’t have to.

How We Help Stroke Victims

Because of our experience representing stroke victims, we understand how the insurance companies try to minimize the residual effects of the stroke. One issue that stroke victims face is determining when they may have reached their full recovery. For some people, it is a three-month window, while for others it takes years. The type and amount of rehabilitation that works well for one person may not have as great an impact on another. The disability insurance company relies on the differences of stroke recoveries to push back on claims.

Depending upon the type of disability insurance policy you own, you may be up against certain time limits to file and/or appeal your claim. Don’t delay in calling our office, because if you lose too much time, you may not be able to file an appeal. These are the details that we need to discuss with you, as soon as possible.

We can fight for your stroke disability claim. Call our office today at 1-877-LTD-CLAIM (1-877-583-2524) or click here to send an email.
