Why There Are No Secrets to Winning a Long Term Disability Insurance Claim

Monday, February 27th, 2017

The simple truth is this: LTD claims are often not easy. The application process is rife with pitfalls, valid claims are frequently delayed or denied, and terminations are common. At Frankel & Newfield, we have seen everything, including claimants whose medical records made it very clear that they were never going to be able to return to their profession, or any work at all, but were told their claims were being terminated because they were “cured” or “improved.” Even when they were suffering from an incurable, or even fatal disease.

There’s also no magic wand or silver bullet to winning a long term disability claim.

Your best chance for success with your claim is to work with a disability lawyer who has years of experience in fighting disability insurance companies on behalf of claimants. Frankel & Newfield partners Justin Frankel and Jason Newfield have focused their law careers on disability law for decades. They aggressively represent their clients in ERISA appeals with disability benefits are denied, delayed or terminated. Frankel & Newfield also represents clients who own private or individual LTD policies.

If your long-term disability policy was purchased through your job, it is considered an employee benefit and is likely to be governed by ERISA, a federal law. You do not have the right to a jury trial. The forum for your appeal is conducted by the same insurance company that denied or terminated your claim. If it seems unfair to you, we agree.

Disability insurance companies are often publicly held companies and as a result, they are focused on maintaining shareholder value. That means any liability –which means paying out claims—is watched very carefully by corporate leadership. The companies don’t make money when they pay claims, only when they sell policies and collect premiums, and when their investment portfolios are making money. A low interest-rate environment, even when markets are booming, can be problematic for these companies, and that is when they will often pressure claims adjusters to deny or delay payment on claims.

In other words, when your claim is denied or delayed, it very often has nothing to do with you or your claim. It’s just business as usual. Except that it’s not for you and your family.

At Frankel & Newfield, we understand that importance of your disability policy and the income needed by your household to maintain your family and your lifestyle. If you are concerned about your disability claim, or have had your claim denied or terminated, call us today and find out how we can help. The call is free – 877-LTD-CLAIM (877-853-2524).
