Long-Term Disability Claims For Impairment From Cardiac Problems

At our law firm, we regularly represent people in their long-term disability insurance claims based on heart disease or cardiovascular disorders, related to the heart or vascular system. These problems cause a variety of symptoms that potentially affect the ability to perform work activities as well as to tolerate work activity. 

Develop the medical evidence 

A challenge in an LTD claim based on cardiovascular illness is to see that the medical record is thoroughly developed to educate the claims examiner about the particular impairment, the symptoms and the resulting limitations on physical and mental work activities as well as on stamina.

A cardiac patient may be extremely limited in the activity level he or she can safely reach. The LTD insurer should not expect someone to return to work if it unreasonably raises the risk of a cardiac event or stroke, for example.

We work with the treating physicians and medical specialists that care for our heart-based disability clients so that the doctors understand the level of detail that is needed in the medical notes and reports. 

Nature of cardiac impairment 

According to the Mayo Clinic, these impairments involve either blocked or narrowed blood vessels or the heart itself like abnormalities of its muscle, rhythm or valves. Some cardiovascular conditions that our LTD clients may have: 

  • Heart failure
  • Heart attack or myocardial infarction
  • Coronary artery disease or CAD
  • Heart transplant
  • Arrhythmia
  • Ischemic heart disease or IHD
  • Chronic venous insufficiency
  • Peripheral arterial disease or PAD
  • Unstable angina
  • Aortic stenosis
  • Pulmonary hypertension
  • Coronary stenosis
  • Stenotic valvular disease
  • Arterial hypertension
  • Hypertrophic cardiomyopathy
  • Angina pectoris or other angina type
  • Edema
  • Hypertension or high blood pressure
  • Congenital heart disease
  • Cardiomyopathy
  • Valvular heart disease
  • Atherosclerosis
  • Aneurysm
  • Marfan syndrome
  • Stroke
  • And others 

Depending on the problem, some common symptoms are chest pain or discomfort, trouble breathing, chest tightness or pressure, fatigue, swelling of extremities, abnormal heartbeat, lightheadedness or fainting, or pain or numbness in legs or arms. Pain may also manifest in the back, neck, abdomen, jaw or throat. 

Anyone filing an LTD claim based on cardiac problems should talk to an experienced LTD attorney for help preparing the claim and the medical evidence. Anyone whose claim has been denied or who has asked for review or appeal should also involve a lawyer as soon as possible. Take care not to miss any deadlines for review or appeal of a denial.
