Holiday Season Poses Potential Pitfalls for Disability Claimants

A few tips for the holiday season from disability lawyers Frankel & Newfield:

If you are remotely considering filing a disability claim, be mindful as you attend holiday gatherings. Social media posts that tag you (include your name and photo) at a lively party could hurt your claim.

If you are waiting for a holiday bonus before making the decision to go out on disability leave, bear in mind that efforts to ramp up your performance before the end of the year – increased sales calls, more travel, etc. – might make a long term disability claims adjuster wonder just how impaired you really are. We’re not saying you should do less than you can do, but if you are making several cross-country trips in a short time to see valued clients, those will be noted as evidence of your ability to perform the tasks of your job.

Traveling for holiday gatherings may draw attention if one of the tasks you can no longer perform for work involves walking, driving or using public transportation. Bear in mind that it is possible that the insurance company is having an investigator take surveillance videos of you laden with gifts and traveling to a variety of parties or family gatherings.

The holiday season is stressful for everyone. Living on disability benefits alone can make gift giving a financial strain. Give yourself permission to emphasize celebrating with a focus on family and friends, and not on gifts. Let your family and friends know that you would rather have visits from them than exchange presents – they will understand.
