Why Is The Disability Insurance Company Giving My Spouse A Hard Time?

It’s difficult to be the spouse who is suffering from an illness or injury and unable to work. It is equally difficult to be the spouse who must provide care, coordinate medical appointments, struggle to maintain some semblance of normalcy and manage the family finances when regular paychecks stop arriving.

Frankel & Newfield often speaks with the spouses of disabled claimants who have not had any luck fighting the long term disability insurance companies on their own, and our conversations often revolve around a handful of concerns:

The well spouse does not want the disabled spouse to worry about finances. This seems to be particularly sensitive where the disabled spouse was a high-income earner, a professional or an executive who, before they were disabled, took a great deal of pride in providing for the family.

The well spouse has never been involved with family finances and, for the first time, is being confronted with having to determine what bills to pay, which cannot be paid, and how to run the household on a severely reduced budget.

Medical bills are starting to pile up and a decision has to be made as to how to pay them. Does the spouse dip into the couple’s retirement plan? If they are close to retirement, will they ever be able to replace the money that was taken out?

Often, it is not until the disability insurance company sends a denial letter that the disabled spouse and the well spouse realize that they will need to retain an experienced disability lawyer to protect them from the financial and emotional devastation that a denied claim can create. We advise men and women to contact our firm before they even begin the process of filing a disability claim, but if the claim has been filed and subsequently denied, it becomes even more necessary to speak with a disability attorney who can help navigate the next crucial steps of the claims process. A misstep during this stage could be devastating to one’s ability to pursue their claims.
