Disability Insurance Applications Process

Wednesday, May 4th, 2016

You are in a state of shock. Through an accident or an unexpected medical diagnosis, your entire world has been thrown into chaos. Your ability to continue working has been stripped. The phone rings constantly with doctor’s appointments, you are faced with multiple healthcare appointments and it seems like someone is always putting another form in front of you for a signature and date.

If you were a highly compensated executive working for a Fortune 1000 company, it is likely that you have a good disability policy with a premium carrier, like CIGNA. But even your pay grade and employment with a brand name company won’t protect you from the challenges presented by your long term disability insurance policy.

Here are a few things you need to know as you begin the process:

Generally speaking, the higher your income level, the more scrutiny you can expect from any disability insurance company, at the beginning and throughout the entire time that you are on claim.

In a similar manner, the younger you are and the higher your income level, the more scrutiny you should expect to get from the disability insurance company. The expectation is that your claim is only going to be temporary and your return to work is inevitable.

If your claim is not for a mental/nervous condition but you find yourself needing support and some pharmaceutical assistance to help at any point in your treatment, expect someone in the disability claims process – a third party reviewer, a claims adjuster, a reviewing nurse – to point to that support or medication and declare your condition a mental/nervous condition, at least in part – which may implicate a limited benefit period for your claim to benefits.

Don’t be surprised by a disability insurance company denial, even when you are completely incapable of anything like getting out of bed or functioning at an executive level. No matter how successful and aggressive you were as a professional or CEO, the claims process is not easily navigated and oftentimes makes no rational sense.

Finally, do not think that the ease with which you navigate the disability insurance company’s claims portal will have any relationship whatsoever to your ability to easily be placed on claim, or to remain on claim.

Our clients range from CEOs and regional managers to doctors, financial executives and even insurance lawyers who thought they could represent themselves.

Frankel & Newfield has years of experience in analyzing policies and coverage provisions, helping clients prepare to file a claim, fighting denied disability claims, negotiating settlements and taking cases all the way to federal court when there is no negotiations.

In the many years that we have been in practice, we have seen many law firms enter the field, claiming that they have the same level of knowledge and experience that we do. We have also seen many lawyers and law firms leave the disability insurance field. We’re still here.

If your disability insurance claim has been denied, or if you are about to file for a disability claim and need some help, call our office at 877-LTD-CLAIM (877-583-2524).
