At Frankel & Newfield, every day we speak with people who are concerned about their Short Term and Long Term Disability (LTD) insurance claims. Many of our free consultations take place by telephone, and often men and women who live near our offices in New York like to stop by our offices for their free consultation.

To make these conversations as productive as possible, we often ask for certain documents or pieces of information. While every situation is different, there are certain situations that come up fairly often.

So that we can give you the best guidance as you weigh your options, here’s a look at some of the documents we ask people to send to us.

If you have not filed your claim or you are looking for representation when your claim has already been filed, the most important document for us to have is a copy of the actual Short Term or Long Term disability insurance policy.

If your claim has been denied or terminated, we will need a copy of the denial letter, and often it is helpful for us to see any supporting medical reports that you have.

If your claim has been denied and you have filed an appeal that has been denied, then we need to be able to review the entire claim file, which you will need to request from the insurance company. This will allow us to consider your claim for litigation.

It’s important for you to know that if you have an ERISA disability claim, you are entitled to a copy of your claims file, and you do not need an attorney to make that request, although we know from long experience that an attorney’s request for a file can often get a faster response.

Also, if your claim has been denied or terminated, we want to see that letter of denial or termination right away. We also ask for any supporting medical records that will provide us with details about your condition – medical narratives, radiology reports, MRIs, nerve conduction studies, etc. The tests we want to see depend upon the person’s condition.

We need this information to give you a clear picture of what options you have. Remember that there are strict time limitations with ERISA disability insurance claims, and it is possible to lose the right to file an appeal or fight an appeal once those limits have passed.
