OVERTURN LIBERTY MUTUAL's SECOND TERMINATION OF DISABILITY BENEFITS

After successfully defending our client when Liberty Mutual first terminated her disability insurance benefits during the "Own Occupation" period of her policy, our client was relieved and hopeful that she could focus on managing her illness. In an unusually aggressive move, Liberty Mutual terminated her disability insurance benefits a second time, only a short time later, when her claim was in the "Any Occupation" review process.

It is important to note that this is not a borderline case. Our client suffers from the acute affects of Lyme disease, Chronic Fatigue Syndrome (CFS) and many related cognitive difficulties. She is unable to work in her previous occupation as a teacher, and is equally unable to perform the duties of any occupation. It is not a happy situation, and having her insurance company come back for a second termination created a host of additional challenges for our client.

On appeal, we secured further medical support from her primary and treating physicians, and rebutted the Peer Review reports which Liberty Mutual had sought to rely upon for the claim termination. We also launched an effort to have the Peer Review doctors, who had been retained by Liberty Mutual, answer our questions concerning their review of our client's condition and her ability to function in the workplace. The doctors refused to respond to our questions.

This was clear evidence that Liberty Mutual's process was skewed, that they routinely retain doctors who are deliberately biased and that their medical evaluations and reports are without merit or substance.

We are pleased to report that our client was reinstated on appeal, and she is again receiving benefits.

If you have been through this process once, and won an appeal, it does not necessarily mean that they have stopped keeping an eye on your claim.
